Former Kroger Employee Files Lawsuit with Claims of Disability Discrimination, Harassment
PLANO, Texas--(BUSINESS WIRE)--A former employee of Cincinnati-based grocery chain The Kroger Co. (NYSE: KR) has filed a discrimination and harassment lawsuit in federal court based on claims Kroger fired him because of his mental and physical disabilities, and despite his multiple commendations and a successful work history.
Plano resident Karl Tipple, 24, filed the suit on September 5 in the U.S. District Court for the Eastern District of Texas in Plano, case number 4:12-CV-00573, after receiving Right to Sue Letters from the Equal Employment Opportunity Commission and Texas Workforce Commission.
The lawsuit alleges that the manager of Kroger Store 581, located in the 2900 block of Custer Road in Plano, repeatedly harassed Mr. Tipple for more than a year, including referring to Mr. Tipple on numerous occasions as a “f------ retarded idiot” who was “too stupid to live.”
Mr. Tipple, who began working at another Kroger location more than six years ago, suffers from an attention-deficit disorder and partial deafness, and has an IQ that allows him to read and write on a third-grade level. He was transferred to Kroger’s Custer Road location in November 2010 as an Assistant Bakery Manager, but was quickly demoted to a checker and bagger position and was forced to file multiple grievances to gain full-time employment from his supervisors.
“This is clearly a case where a high-functioning person with special needs has been victimized by the prejudices and bias of his manager, all supported by other Kroger officials,” says attorney Matthew Scott of the Kendall Law Group in Dallas, who represents Mr. Tipple. “Karl has a longstanding record as an exemplary Kroger employee, but that didn’t seem to matter when he moved to the new store. After his transfer, Karl faced a series of attempts to bully and scare him into quitting.”
According to the lawsuit, the store manager frequently yelled at Mr. Tipple on the sales floor, forced him to work alone on certain tasks, brought unsubstantiated allegations against him from other employees, and ultimately filed a false customer complaint that was later withdrawn. In addition, the manager confiscated Mr. Tipple’s personal cell phone, apparently believing that the phone was being used to document violations of corporate and union policies by the manager and other employees. Until his firing in December 2011, Mr. Tipple served as the youngest elected Steward of the United Food and Commercial Workers Union in Kroger’s history.

Kroger keeps going on for 18 months no vacation or back pay still I well enjoy court with them I'm not backing off or going down I keep fighting been that way all my life I'm waiting on getting this over to work on a book "Kroger life been disabled" ebook format so much to finally get my name clean and my money that owned to me 19 months soon still Kroger fights ..then I'm about to get a job and fix my company

Various Updates
Sandi is doing okay tonight. As always,
these trips out to the doctor tired her out,
but, she says she didn't nap while I was
gone.
Karl had his deposition for the wrongful
termination case against Kroger today.
While I was forbidden from being there,
Kroger deliberately had William "Bill"
Latham attend on their behalf. Considering
what the former store manager of Kroger
#581 in Plano did to Karl and how he
shoulders major responsibility for the case,
I don't remotely understand how this was
permitted or why the Kroger folks thought
this would be a good idea. If they thought
this would somehow intimidate Karl it
epically failed.
Both Karl and I were rather amused when
it was over as Latham would not look at
me or my walker and then practically ran
to the elevator bank to leave the area. I
don't know why that happened, but, it
was flat out funny as he ran like a scalded
cat. One of the very few things funny in
this 18 month plus mess they created.
We still don't know about Medicaid for
Sandi. The medical bills keep coming (8
today) and today we also got yet another
incorrect error filled eob from insurance
that will have to be appealed. AETNA
seems just as bad as BLUE CROSS/ BLUE
SHIELD OF ARKANSAS was as every
single eob seems to have an error on it.
Very frustrating.
She now has some sort of phone interview
for 8:30 Thursday morning with some folks
connected to Social Security disability.
That was to be the one morning we could
sleep in a little bit this week so, of course,
that is out the window.
Nothing new on the money front as we are
way, way short of the rent, utilities, my
over due car payment, etc. I'm in denial
mode trying not to panic. Sandi and I will
be calling a couple of the local charity
groups tomorrow to see if they have
changed their minds or have gotten any
funds to be able to help us. We figure this
is an exercise in futility as it has been in
recent months, but, we have no idea what
else to do.
Things seem pretty hopeless on this and
on everything in general. Tomorrow is
another day....."
We'll then different really just same old stuff
this why my store is closed I'm trying to get a laptop I'm not rising money for my lost money for four months starting to really add up
